Terms of Service

By accessing and using SoftSysVideo ("the Service"), you accept and agree to be bound by these Terms of Service. If you do not agree, please do not use the Service.
1. Acceptance of Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you (the "User" or "Tenant") and SoftSys Solutions S.A.S ("we", "us", or "Company"), a company registered in Medellín, Colombia. By creating an account or using SoftSysVideo, you confirm that you have read, understood, and agree to be bound by these Terms.
2. Description of Service
SoftSysVideo is a serverless video conferencing platform designed specifically for Moodle LMS. The Service provides:
- Real-time video conferencing sessions compatible with BigBlueButton API
- Recording capabilities for video sessions
- Cloud storage for recordings
- Administrative dashboard for managing meetings and usage
- Multi-tenant architecture with secure data isolation
The Service is provided on a usage-based pricing model where you purchase credits that are consumed based on your usage.
3. Pricing and Credits
3.1 Pricing Structure
SoftSysVideo uses a prepaid credit system with the following rates:
- Participant Minutes: $0.004 USD per participant per minute
- Recording Processing: $0.02 USD per minute of recorded video
- Storage: $0.030 USD per GB per month for storing recordings
3.2 Welcome Credits
Upon successful registration, new accounts receive $20 USD in free credits to test the Service. These welcome credits are non-refundable and subject to the same terms as purchased credits.
3.3 Credit Purchase and Usage
Credits must be purchased before use and are consumed in real-time based on your usage. Credits do not expire but are non-refundable except as specified in our Refund Policy. You are responsible for monitoring your credit balance to ensure uninterrupted service.
3.4 Payment Processing
All payments are processed securely through PayPal, our authorized payment processor. By making a purchase, you agree to PayPal's terms and conditions. We do not store your payment card information.
4. Acceptable Use
4.1 Permitted Use
You may use the Service solely for lawful purposes related to online education, training, meetings, and collaboration. The Service is intended for integration with Moodle LMS installations.
4.2 Prohibited Activities
You agree not to:
- Use the Service for any illegal activities or to violate any local, national, or international law
- Transmit harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable content
- Attempt to gain unauthorized access to the Service, other accounts, or computer systems
- Interfere with or disrupt the Service or servers or networks connected to the Service
- Use the Service to transmit spam, viruses, malware, or any other malicious code
- Reverse engineer, decompile, or attempt to extract the source code of the Service
- Resell or redistribute the Service without explicit written authorization
- Use automated systems or bots to access the Service in a manner that exceeds reasonable usage
- Share your account credentials with unauthorized third parties
4.3 Content Responsibility
You are solely responsible for all content transmitted through the Service, including video, audio, chat messages, and shared documents. We reserve the right to review content for compliance with these Terms but are not obligated to do so.
5. Intellectual Property
5.1 Our Rights
The Service, including all software, designs, graphics, text, and other content, is owned by SoftSys Solutions S.A.S and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Service without explicit written permission.
5.2 Your Content
You retain all rights to the content you upload, transmit, or store through the Service. By using the Service, you grant us a limited license to host, store, and transmit your content solely for the purpose of providing the Service. We do not claim ownership of your content.
5.3 Recordings
Recordings created through the Service belong to the tenant (you) who initiated the recording. You are responsible for obtaining necessary consents from participants before recording sessions, in compliance with applicable privacy and data protection laws.
6. Account Termination
6.1 Termination by You
You may terminate your account at any time through the dashboard or by contacting our support team. Upon termination, your remaining credits will be forfeited and are non-refundable unless you qualify under our Refund Policy.
6.2 Termination by Us
We reserve the right to suspend or terminate your account immediately if:
- You violate these Terms of Service
- Your usage patterns indicate fraudulent or abusive behavior
- You fail to pay for services or engage in payment disputes
- We are required to do so by law or court order
- Continued provision of service poses a security or legal risk
6.3 Data Retention After Termination
Upon account termination, we will retain your data for 30 days to allow for account recovery if needed. After this period, all data, including recordings and meeting history, will be permanently deleted. You may request immediate data deletion by contacting support.
7. Limitation of Liability
7.1 Service Availability
We strive to maintain 99.9% uptime but cannot guarantee uninterrupted or error-free service. The Service is provided "as is" and "as available" without warranties of any kind, either express or implied.
7.2 Limitation of Damages
To the maximum extent permitted by law, SoftSys Solutions S.A.S shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses resulting from:
- Your access to or use of (or inability to access or use) the Service
- Any conduct or content of any third party using the Service
- Unauthorized access, use, or alteration of your transmissions or content
- Service interruptions or errors
Our total liability for any claims arising from the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.
7.3 Third-Party Services
The Service may integrate with third-party services and platforms. We are not responsible for the availability, functionality, or security of third-party services. Your use of third-party services is governed by their respective terms.
8. Privacy and Data Protection
Your privacy is important to us. Our collection, use, and protection of your personal data are governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to our Privacy Policy.
9. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of significant changes by email or through a notice in the dashboard. Your continued use of the Service after changes are published constitutes acceptance of the modified Terms. If you do not agree with the changes, you must stop using the Service.
10. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of Colombia, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Medellín, Colombia.
